FAIRMONT —Bail has been reduced for the third man who was taken into custody on charges in connection with a fight between two motorcycle clubs that occurred on Aug. 3 at the BFS Foods convenience store in White Hall.
Court records show bail for Jason “Jay Bird” Harris, 49, of Fairmont, was reduced from $1,000,012 to $750,000 during his recent preliminary hearing before Marion County Magistrate William T. Holmes in Fairmont.
Harris, who was taken into custody Aug. 23 without incident at an acquaintance’s residence in Fairmont, was wanted by the White Hall Police Department for attempted murder and conspiracy to commit a felony.
He waived his preliminary hearing and the charges were bound over Sept. 3 to Marion County Circuit Court, according to court records.
According to a press release from the U.S. Marshal Service office in Clarksburg, Harris is believed to have stabbed a man during a fight between the Pagan Motorcycle Club and the Hell’s Angels Motorcycle Club Aug. 3 at the BFS Foods convenience store in the Middletown Mall entryway.
Marion County Assistant Prosecuting Attorney JT Hodges said Harris’ attorney filed a motion that Harris’ bail be reduced in accordance with the other two people charged in the incident, and the magistrate agreed it was the “right thing to do.” Court records show Harris is in North Central Regional Jail.
Hodges said unless a plea would be offered or Harris would take a plea, the “next logical step” would be for Harris’ case to be presented to the grand jury for an indictment.
He believed that some laboratory work had been submitted as part of the investigation, and authorities were waiting for test results to come back.
Also, Hodges said additional terms were set for Harris by the magistrate. Harris was ordered to stay away from the victim, have no contact with the victim, stay away from BFS Foods and surrender all firearms and weapons, Hodges said.
Police said the stabbing victim, Kenneth Murphy of Hilton, New York, was taken to Ruby Memorial Hospital in Morgantown and later released. Hodges said Murphy is recovering.
Also charged along with Harris are James Cody Biggie, 37, of 202 Skyline Dr., Rivesville, and Bruce Evan Davis, 53, of 135 Pine Ln., Fairmont, who also face identical charges of attempted murder and conspiracy to commit a felony in the incident.
A criminal complaint states that Biggie and Davis, along with Harris and a fourth man, carried out what police called “a pre-planned physical confrontation with several male individuals in the parking lot of the BFS Foods in White Hall.”
The incident has been described as a fight between the Hells Angels and Pagan motorcycle clubs. At 1:50 p.m. on Aug. 3., a Monongalia Emergency Centralized Communication Agency 911 report stated there was “a fight/stabbing in Fairmont between Hell’s Angels club and Pagan’s Motorcycle Club, and that one of the Hells Angels members was being transported to Ruby Memorial Hospital.”
On Aug. 12 at his preliminary hearing, Davis’ bail was reduced from $750,00 to $450,000.
Then, on Aug. 13 at his preliminary hearing before Marion County Magistrate Todd Rundle, Biggie’s bail was reduced from $1,030,000 to $500,000. Biggie, who attended, waived the preliminary hearing and his case is now headed to Marion County Circuit Court.
Police are still searching for the fourth suspect in the case. That suspect’s name has not been released.
